Defendant shall be punished by a fine of KRW 700,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The Defendant is a person who operates a restaurant in the name of “C” in the smuggling B.

No person who sells or provides agricultural and fishery products or the processed products thereof after cooking shall place a false indication of the place of origin or place a mark likely to cause confusion therewith.

Nevertheless, from December 11, 2018 to January 18, 2019, the Defendant purchased a total of 60 kg of Korean Chinese Chinese culture from the above restaurant and provided customers with consent, and made an indication that the country of origin of kimchi may cause confusion as a domestic origin with the country of origin indicating the origin of kimchi as an "import & domestic origin" on the Q New Markets.

The reason for sentencing under Article 334(1) of the Criminal Procedure Act of the provisional payment order is against the defendant, and the sentence shall be imposed in consideration of all the circumstances, including the following: (a) the defendant's previous Chinese restaurant operated by the defendant used the same domestic products as the domestic products, and the fact that there are circumstances to take into account the circumstances in relation to the crime, such as the fact that the defendant's use of only the traditional Korean products was under control, and then purchased and used only the traditional Korean products.
