Reasons
Punishment of the crime
Defendant A is sentenced to ten months of imprisonment with labor for a violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes at the Seoul Eastern District Court on February 14, 2017 and the same year.
8.4. The execution of the sentence was completed in a female prison.
On December 4, 2018, the Defendant posted a false statement stating that “Aphone6S 64 is to sell a mobile phone,” “Aphone64 means to send a mobile phone to the victim E who has contacted the victim E by reporting that “I will send a mobile phone if I transfer KRW 133,00,00,” and that “I will send a mobile phone if I transfer KRW 70,000,” to the victim F who has contacted the victim F who has reported the same article on the 17th day of the same month.”
However, the defendant had no cellular phone at the time, so there was no intention or ability to send things even after receiving the price from the victims.
As above, the Defendant, by deceiving the victims, was transferred from the victim E to the G account (H) account in the name of the Defendant, KRW 203,000 in total, including KRW 133,000 around December 4, 2018, and KRW 70,000 in around December 18, 201, from the victim F.

1. On October 15, 2018, the Defendant posted a false statement stating that “Aphone8 is to sell opphone8” by accessing Suwon-si I Apartment Complex J and Internet K at Suwon-si around October 6, 2018, the Defendant sent a false statement to the victim L who reported and contacted this.”
However, even if the defendant receives the price from the victim, he did not have the intention or ability to send the goods.
Around October 15, 2018, the Defendant, by deceiving the victim as above, received KRW 200,000 from the victim’s G account (Account Number: H) in the name of the Defendant.
