A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

From January 18, 2012, the Defendant operated a mobile phone sales store in the name of “E” in the name of Defendant’s spouse D (hereinafter “instant sales store”) on the Seo-gu, Seo-gu, 3 Dong 2, Gwangju, and was engaged in the sales and receipt of payment for the mobile phone supplied by “G” (hereinafter “instant agency”) from around November 2013, which is the mobile communications agency operated by the Victim F.

1. On April 7, 2014, the Defendant was informed of the fact that the mobile phone purchaser was prohibited from selling the mobile phone at the sales store instead of paying the short-term terminal price from the above damage, and even though he was well aware of it, the Defendant sold the mobile phone by means of supporting 30,000 won a month from the Internet for a maximum of 36 months, the Defendant pretended that the victim was recruited to invite members by normal door-to-door sales or multi-stage sales and sold it to the victim, and then acquired it through a total of 76,967,00 won from the victim on a total of 75 times, such as the first half of the annexed crime list 1.

2. The Defendant, on April 7, 2014, sold a mobile phone device to H by means of a normal door-to-door sales or multi-stage sales, despite the fact that he/she sold the mobile phone device to H by means of an Internet page, as set forth in paragraph 1, was pretended as if he/she sold it by means of a normal door-to-door sales or multi-stage sales, and the Defendant was granted KRW 2,80,000 to the Defendant’s spouse’s bank account (I) in the name of the Defendant’s spouse, as a payment for sales around April 10, 2014.

Until April 25, 2014, the Defendant, as well as this, received total of KRW 15,000,000 through nine times, as shown in attached Table 2, from the Defendant, to the head of the Tong in the name of the above D as a sales allowance.
