1. The plaintiff's claim of this case is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Facts of recognition

On January 17, 2007, the Plaintiff entered into a sales contract with the KC Industry Development Co., Ltd. with respect to the real estate listed in the attached Form (hereinafter “instant store”) among the commercial buildings (hereinafter “the instant building”) on the land (hereinafter “the instant building”) on the land (hereinafter “the instant building”), B and eight parcels of land (hereinafter “DD”) on the following occasions: KRW 905,40,00; KRW 181,188,480,00 for intermediate payment first 181,18,480 for intermediate payment; and KRW 181,18,48,480 for intermediate payment first 17, 2007; and the second 181,188,48,480 for intermediate payment second 181,7 July 17, 2007; and KRW 352,376,960 for each of the instant building (hereinafter “the instant sales contract”).

On January 17, 2007, the Plaintiff transferred KRW 362,376,960 in total to the foreign exchange bank account of the K Industry Development Co., Ltd. as stated in the instant sales contract, KRW 300,000 in total to the foreign exchange bank account of the KFS Co., Ltd. on March 19, 2007, and KRW 181,18,480 in total to the national bank account of the KM Industry Development Co., Ltd. on July 18, 2007.

Accordingly, on January 17, 2007, the KC Development Co., Ltd. issued to the Plaintiff a tax invoice with the sum of KRW 150,990,40,00, the sum of the supply value of the goods “site” 151,386,560, the aggregate of the supply value and the tax amount of the goods “second intermediate payment” on July 18, 2007, the sum of the supply value and the tax amount of the goods “second intermediate payment” on KRW 181,18,48,480, and each tax invoice with the aggregate of KRW 352,376,960,960, which was issued to the Plaintiff. On January 17, 2007, the Co., Ltd. prepared a receipt on KRW 362,376,960, under the pretext of the first intermediate payment and additional tax payment, and issued the balance to KRW 362,376,960,168,568.
