A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
On April 28, 2011, the Defendant was sentenced to six months of imprisonment by the Suwon District Court due to night residence intrusion, larceny, etc., and was released on January 30, 2012 and the remaining term of imprisonment has expired on February 19, 2012.
1. Around 22:10 on February 21, 2013, the Defendant: (a) opened a cash check and a password of the victim’s corporate bank E, along with the Defendant’s request for withdrawal of KRW 200,000 in cash from the victim E, a customer, and withdrawn KRW 20,000 in cash from the cash withdrawal machine installed at the G convenience point located in F on the same day at around 22:16 on the same day.
The Defendant, around the same day, who carried the above CC card and cash 200,000 won owned by the victim and returned to the D C CC page, and kept it for the victim, and embezzled without returning it to the victim.
2. Larceny;
A. From February 21, 2013 to February 22:23, 2013, the Defendant withdrawn KRW 200,000,000 from the cash withdrawal period managed by the Korean National Bank of Korea, Inc., Ltd., an international branch of the Korean National Bank 1021-14 on the same day, to three times each by using the e corporate bank cke card embezzled as referred to in the above paragraph (1). From around 22:27 of the same day to 22:28 of the same day, the Defendant withdrawn KRW 1 million from the cash withdrawal period managed by the victim at the point of notification of the national bank 94-2 of the same day by the same method, and cut the sum of KRW 5 million in cash owned by the victim.
B. On March 8, 2013, the Defendant: (a) around 05:30 on March 8, 2013, while working for the victim I on the fifth floor of the HA of the Heung-gu H building, the Defendant, alone, with the resident registration certificate owned by the victim K, the victim L driver’s license owned by the victim, and the victim M driver’s license owned by the victim, while working for the victim I on the fifth floor of the Heung-gu H building as an employee.
