피고인은 2013. 5. 21. 부산 동래구 C 소재 ‘D회사’ 내 탈의실에서 직장동료 E과 다투던 중 피해자 F가 싸움을 말리며 피고인을 발로 찼다는 이유로 “이게 어디서 사람을 치노. 씨발년 때리 직이삔다. 칼로 찔러 직이삔다.”라고 말하며 해악을 가할 듯한 태도를 보여 피해자를 협박하였다.
