1. Of the judgment of the court of first instance, the part against the defendant in excess of the amount ordered to be paid below shall be cancelled.
Reasons
1. Basic facts
A. The Plaintiff is a corporation that engages in the business of manufacturing electronic parts, etc. under the trade name of “C” from “S,” and the Defendant is a corporation that engages in wholesale and retail business of cosmetics, labeling printing and selling business.
B. The Defendant was requested by the manufacturer and selling company for the delivery of Maspacts by the “Maspact shop.”
For its delivery, the Defendant issued an order to the non-party L&C Co., Ltd. to the original material and re-printed to the non-party L&C Co., Ltd., and had the original material supplied from the original material printed to the non-party L&C Co., Ltd. print various kinds of infinite forms (animal face shapes, such as tigers, scin, and do so) in the original body, let the company in the form of non-printed pattern printed (hereinafter referred to as “the instant processing”) process it, re-issued it, supplied it, and finally processed it, and finally supplied it to the “Raf shop.”
C. Around January 2015, the Defendant contracted the instant processing to the Plaintiff during the aforementioned process.
