A defendant shall be punished by imprisonment for two years.

Punishment of the crime

1. On August 2007, the Defendant prepared a false complaint at the Seocho-gu Seoul Seocho-gu Seoul Seocho-gu Office for the purpose of having D criminal punishment.

The contents of the complaint are that "D, the representative of the EE, did not have any intent or ability to fully repay the construction cost even if it is entrusted with the new construction of a G factory located in the Cheongbuk-gun, Chungcheongnam-gun, and that D, on September 19, 2006, entered into an agreement between the complainant and the contract amount of KRW 4.22 billion, and entered into an infinite contract in order to show it to other constructors, and made the other constructors prepare a false contract for construction cost of KRW 2.310 million, which is the difference by asserting that it is a true contract and by deceiving it without paying KRW 1.914 billion, which is the difference."

However, at the time of the filing of a contract, the parties agreed to the contract amounting to KRW 2.31 billion (hereinafter “the fourth contract”). The contract amounting to KRW 4.22 billion (hereinafter “the third contract”) was entered into a false contract made under mutual agreement in order to obtain more loans from the Small and Medium Business Corporation (hereinafter “the third contract”). At the time of the filing of a complaint, D up to the time of the complaint was not more than KRW 2.1 billion in the contract amount pursuant to the third contract, KRW 384 billion in the contract amount equivalent to value-added tax pursuant to the third contract, KRW 384 billion in the contract amount, and KRW 177 million in the Defendant’s request with the details of additional construction expenses on June 20, 2007, the total contract amounting to KRW 2.66 billion in the contract amount, and KRW 2.41.6 billion in the contract amount on behalf of the Defendant in addition to the defect repair expenses, the contract amount was more paid.

Nevertheless, around August 17, 2007, the defendant filed the above false complaint with the Seoul Central District Public Prosecutor's Office, which is located in 158 according to the distribution of Seocho-gu Seoul Seocho-gu, Seocho-gu.
