피고인은 ‘B’ 아파트 209호, 피해자 C( 여, 66세) 은 같은 아파트 309호에 거주하고 있다 피고인은 2016. 6. 27. 15:40 경 서울 도봉구 B 아파트 309호 엘리베이터 앞에서 피해자가 현관문을 세게 닫아 시끄럽다는 이유로, 피해자를 찾아 가서 “ 야, 너 빡 치면 뒤져!, 이 씨 발년이 뒤 질려고!! 너 그 딴 식으로 깐죽거리면 너 뒤져 씨발 년 아! "라고 말하여 마치 피해자의 생명이나 신체에 어떠한 위해를 가할 듯이 협박하였다.
