1. The instant lawsuit shall be dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Details of the disposition

The Minister of Trade, Industry and Energy, in accordance with Article 5 of the Industrial Design Promotion Act, Article 7 of the Enforcement Decree of the same Act, and the 2014 Government Rewards Guidelines, the Minister of Trade, Industry and Energy, who contributed to the promotion of design management and the promotion of enterprises on May 15, 2014, decided to award prizes, such as orders, medals, presidential commendation, Prime Minister commendation, and the Minister of Trade, Industry and Energy commendation, etc. in the field of design merit, and upon receiving the recommendation from the candidate's direct application or excavation promotion group from June 23, 2014 to July 22, 2014, the Minister of Trade, Industry and Energy, upon receipt of a recommendation from the government reward guidelines and the official reward review committee, shall determine the number of winners and the final number of winners in accordance with the

(Public Notice of Ministry of Trade, Industry and Energy No. 2014-221, hereinafter “Public Notice of this case”). On July 21, 2014, the Plaintiff applied for the grant of the Design Round to the Minister of Trade, Industry and Energy, and submitted documents, such as a statement of public records.

On May 26, 2014 and June 17, 2014, the Korea Institute of Design Promotion recommended 36 candidates for each category of design work, including the Plaintiff, to the Minister of Trade, Industry and Energy through the Review Committee on August 5, 2014.

The Minister of Trade, Industry and Energy proceeds from September 12, 2014 to the 22th of the same month, after inquiring about criminal records, etc. from September 8, 2014 to the 30th of the same month, and recommended B to the Minister of Security and Public Administration, through the Public Review Committee held on October 8, 2014, as one of the subjects of the Order of G Industry, C, H Industry Merit, E, and F.

On October 31, 2014, the Defendant published the order of G Industry Merit, C in the Official Gazette that the H Industry Merit, D, I, E, and F award J Service Merit, on the official gazette.

(2) The court below held that the defendant's selection of the orders and medals for the defendant's Eul et al. (hereinafter "the defendant's selection of the orders and medals of this case") was without dispute (the grounds for recognition), Gap's 1 through 6, Eul's 1, 2, and 3, and the purport of the main defense of this case as a whole.
