A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On February 20, 2013, the Defendant was sentenced to six months of imprisonment or one year of suspended execution for violating the Military Service Act at the Busan District Court on February 20, 2013, and the said judgment became final and conclusive on February 28, 2013 and is still under suspended

No public duty personnel shall desert away from their service or serve in the relevant field for at least eight days in total without justifiable grounds.

The Defendant did not work at the D Station for eight days from April 2, 2013 to May 5 of the same month, and from April 8, 2013 to April 11, 2013 to April 11, 2013 without any special reason.

Accordingly, the defendant left his service for not less than 8 days without justifiable grounds.
