1. The Defendant’s KRW 93,00,000 and the Plaintiff’s 15% per annum from January 29, 2019 to May 31, 2019.

Comprehensively taking account of the statements in subparagraphs 1 through 10 and the overall purport of the pleadings in the testimony of the witness C, C, a new house constructor, shall be the Plaintiff engaged in the new house construction business, etc. in the name of “D”, and around February 2, 2017, by entering into a contract for the new house construction work among the new house construction works in the Dongbcheon-si E, Dongbcheon-si, and around March 2017, by entering into a contract for the new house construction work in the name of “C”, and C, a new house constructor, established on May 14, 2017, in order to facilitate the progress of each new house construction work in the above new house, was actually operating the Defendant Company as the representative director of the Defendant Company, and around June 2017, C, a written contract for each contract for the new house construction work in the name of the Defendant Company, the contract amount was KRW 175 million,000,000,000 among its representative directors, and the amount was KRW 93 million.

According to the above facts, C, a person who actually established the Defendant Company for each of the above new construction works of multi-family housing, has established “D settlement” to confirm the construction cost for each of the above construction works by comprehensively obtaining the G as the representative director and obtaining all the rights comprehensively from him, and thus, C, it is deemed that the above settlement has its effect against the Defendant Company.

Therefore, as the Plaintiff seeks, the Defendant Company’s payment of KRW 93,00,00,00, which is due to the above settlement statement, and the Plaintiff’s payment of the copy of the complaint in this case, is clearly recorded from January 29, 2019 to May 31, 2019, the main text of Article 3(1) of the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings, and 15% per annum under the former Enforcement Decree of the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings (amended by Presidential Decree No. 29768, May 21, 2019).
