Defendant shall be punished by a fine of KRW 3,000,000.
When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
The Defendant purchased a factory site and carried out the business of selling it in installments, and had the Defendant enter into the said contract in the name of the arche B without the consent of the arche B.
1. On April 14, 2011, the Defendant: (a) drafted a real estate sales contract for the “D Licensed Real Estate Agent E in the Gu, Si, Si, Gu, Si, and Gu; (b) without B’s consent, entered the buyer’s second address column in “Seoul Metropolitan City North G; (c) “H”; (d) in the column of resident registration number; and (e) signed B’s seal in the column of name; and (e) issued the said real estate sales contract to the seller, the seller, who is not aware of the fact that the contract was duly formed, with B’s seal affixed thereon.
Accordingly, for the purpose of exercising, the Defendant forged and exercised one copy of the real estate sales contract, which is a private document on rights and duties.
2. On May 30, 2011, the Defendant drafted a sales and sales contract for part of the factory site of the Gu, Si, U.S., and the seller’s joint address column, stating “G” in the seller’s joint name address column “G” and “B” in the seller’s name column, signed B’s seal on the next side, and issued the said contract to the representative of the LU.S. in charge of the transaction plan, who is not aware of the fact that the contract was duly formed.
Accordingly, the defendant forged and exercised a copy of the factory site contract, which is a private document on the rights and duties, for the purpose of exercising them.
3. On May 31, 2011, the Defendant, at the same place as indicated in the foregoing paragraph 2, prepares a sales and sales contract for part of the factory site for Gumi-si E and F at the same time as indicated in the foregoing paragraph 2, stating “G” in the seller’s joint address column, “I” and “B” in the seller’s name column, and then affix B’s seal and seal on the next side, as if they were duly formed.
