피고인은 광주 동구 B에서 ‘C’이라는 상호로 일반음식점을 운영하면서 농수산물이나 그 가공품을 조리하여 판매, 제공하는 사람으로서, 2012. 11. 2.경부터 2013. 5. 31.경까지 위 음식점에서 주식회사 에이젯푸즈(광주 북구 신안동 1-1)와 주식회사 밀리언미트(광주 서구 매월동 180)로부터 미국산 돼지고기 목전지 1,342.7kg을 6,352,470원에 구입하고, 미국독일스페인산 돼지고기 삼겹살 약 103kg을 666,272원에 구입하여 돼지고기 목전지는 참숯석쇠정식, 주물럭쌈밥 메뉴로, 삼겹살은 통삼겹바베큐 메뉴로 조리하여 판매하면서도 메뉴판에 농산물인 돼지고기의 원산지 표시를 ‘국내산＋미국산’으로 기재함으로써 위 업소를 찾은 손님들로 하여금 혼동하게 할 우려가 있는 표시를 하였다.
