1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Details of the disposition

A. On September 3, 2013, the Plaintiff reported to the Defendant on September 3, 2013, that he/she would build Class 1 neighborhood living facilities of the light-frame structure with a building area of 96.93 square meters on the ground of the Plaintiff’s 1084 square meters (hereinafter “instant site”) among the land owned by the Plaintiff’s Dong-si C, Busan-si, 1084 square meters (hereinafter “instant application site”).

B. On October 11, 2013, the Defendant issued a disposition not to accept the instant building report on the ground that “The construction report is an area promoting “a project for the conservation of the natural environment and the creation of a forest recreation space” to which the application for the construction report was filed, and if a building is newly constructed, it would lead to continuous development pressure as a precedent for development due to various development activities at a tourist masters preserved and managed during the construction period, and would pose a substantial obstacle to the promotion of the project for the river tending.”

The Plaintiff’s assertion as to the lawfulness of the instant disposition is obligated to accept the instant construction report, unless there is any ground for restriction under the Building Act or the relevant Acts and subordinate statutes, and the instant construction report is substantially interrupted after the designation of a tourism and recreation development promotion district for the whole region including the instant application site was cancelled on July 201. The instant construction report is not a ground for rejection of the instant construction report, and there are lots of restaurants with frequent and frequent traffic of people and vehicles, and there are places attached to the parking lot prior to the commencement of the mountain, and the filing of the instant application is located within the area adjacent to the parking lot.
