1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Details of the disposition;

A. On December 17, 2014, the Plaintiff: (a) acquired 14 chartered buses (10 vehicles and 4 used cars) and its transport business rights from a stock company B (hereinafter “B”); (b) and (c) completed the registration of passenger transport business on June 18, 2015 and engaged in the chartered bus transport business.

B. On the other hand, on January 20, 2015, C, who served as a driver driving a chartered bus in B, accused that B, in violation of Article 12 of the Passenger Transport Service Act, carried out the operation of five vehicles in the investigative agency, and as a result of the investigation, B representative director D was indicted pursuant to Article 90 Subparag. 3 and Article 12 of the Passenger Transport Service Act on the ground that B committed the following offenses (hereinafter “instant illegal act”).

Defendant (D) is the B representative director for the purpose of the chartered bus business, etc. in E at the time of the grace, and F, G, H, I, and J are the drivers belonging to the above company.

No transport business operator shall allow any person who is not a transport business operator or a person who is not a transport business operator to run passenger transport service with or without any consideration using his/her commercial motor vehicle.

1. From January 2007 to December 17, 2014, the Defendant had KH119, which actually owned by J, registered in the name of B, and had J carry out passenger transport business by having the said vehicle transport passengers.

2. From April 2010 to December 17, 2014, the Defendant: (a) had a G-owned LH119-type passenger vehicle registered in the name of B; (b) had G transport the passengers with the said vehicle; and (c) had G operate passenger transport business.

3. The Defendant, from September 29, 2010 to December 17, 2014, had the passenger transport business registered under the name of the I-owned M&C-type vehicle B, and had I transport the passengers with the said vehicle.
