1. The defendant shall pay 150,000,000 won to the plaintiff and 15% per annum from September 2, 2015 to the day of complete payment.
Reasons
In fact, on April 15, 2015, the Defendant issued and delivered an electronic bill (hereinafter referred to as “instant electronic bill”) containing the following content on the e-mail Co., Ltd. (hereinafter referred to as “large Metal”)
The issue amount: The issue amount: 495,000,000 issue date: The issue date on April 15, 2015: 1153-ro 1153,000,000,000,000 for the e-bill (hereinafter referred to as “instant divided bill”) of the instant electronic bill on July 30, 2015, is issued and transferred in sequence to the Plaintiff, and the Plaintiff holds the instant divided bill, in which the electronic bill (hereinafter referred to as “instant divided bill”) of KRW 150,00,000,00, which was divided from the instant electronic bill on July 30, 2015, from the e-bill metal to the future electric power industry development company, B (C), Austria Korea, D, and Plaintiff.
The Plaintiff presented the instant installment bill to the said payment bank on the maturity date, but the payment was refused.
[Ground for recognition] No dispute exists, the issuer of the instant sub-bill bears the obligation to pay the amount of the KRW 150,00,000 and the delay damages calculated at the rate of 15% per annum from September 2, 2015 to the day of complete payment, following the delivery of the original copy of the instant payment order, as sought by the Plaintiff.
The defendant defenses by the defendant issued and delivered the electronic bill of this case to the Daero Metal for the purpose of requesting the discount of bills to raise operating funds, and the plaintiff did not have any economic interest in claiming the payment of the bill, by being endorsed and received from D without any grounds. Thus, the plaintiff is not liable to pay the amount of the bill of this case
In fact, on April 15, 2015, the Defendant issued and delivered the instant electronic bill to the ero metal, and then agreed that the erogram is 60% of the instant electronic bill discounted to a third party, and that the Defendant would use 40% of the discount, and pursuant to this agreement, the Defendant is on the ero metal.
