A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
The Defendant stated that “The Defendant would make a promise to make a new mixed tour normally on August 30, 201, while counseling with the victim E and telephone around August 30, 201, as the representative of D Co., Ltd. located in Gangnam-gu Seoul Metropolitan Government CA building 1807, and as the Defendant would make a promise to pay travel expenses necessary for hotel and airline ticket reservations.”
However, even if the defendant is paid travel expenses from the victim, the defendant did not have the intention or ability to make up for overseas travel normally due to the financial difficulties of the travel agency operated by the defendant.
Nevertheless, the Defendant deceivings the victim as above, and received KRW 8,00,000 from the victim to October 31 of the same year from the same day as travel expenses, and acquired KRW 17,80,000 in total from the victim 4 by the same method as shown in attached Table 1, from that time to December 15 of the same year.

1. On June 3, 2011, the Defendant: (a) made a travel contract with the victim F by stating that “The Defendant would send a new package tour to the victim F on December 24, 201, without any intention or ability to send a new package tour even if he/she received a package tour from the customer due to the company’s financial difficulties at the above travel agency office; (b) made a travel contract by stating that “The Defendant would send a new package tour to the victim F via the Internet site on December 24, 201; and (c) received from the victim KRW 600,000 on the same day on the same day, KRW 5,209,000 from the victim and KRW 5,809,000 on the same day on the same day.”
2. On November 19, 201, the Defendant against the victim H did not have the intent or ability to send a new package tour at the above travel agency office as described in paragraph (1) above, and even if he did not have the intent or capacity to send a new package tour, the Defendant’s fraud against the victim H from April 1, 201 to the victim H.
4. Until June 1, 200, the expenses for the new marriage in Thailand shall be KRW 3.122,00,000 and the down payment shall be paid at the 600,000,000,000,000,000.
