Reasons
Punishment of the crime
The defendant received a proposal from C to obtain a loan from a victim's financial institution by using a false lease contract, certificate of employment, etc., and consented thereto, and conspired with C to acquire a loan by deceiving a financial institution by deceiving the loan by deceiving the fact that the loan of the lease of the lease of the lease of the house to ordinary people who are employed by the Korea Housing Finance Corporation as financial resources of the National Housing Fund is made only without due diligence
On July 29, 2014, the Defendant: (a) entered into an apartment lease agreement with the lessor F to the effect that “E real estate” located in Daejeon-gu Daejeon-gu, Daejeon-gu, had no intention to rent and actually reside therein; and (b) entered into a lease agreement with the lessor G 1,20,000 won of deposit KRW 12,00,000,000 and for two years of lease; and (c) received a false certificate of employment with H, stating that the Defendant was working for “H” around that time.
On August 6, 2014, the Defendant submitted a lease agreement and a certificate of employment to an employee in charge of the Victim Han Bank, which was 282 (Korean Ambassador Dong-dong) and filed an application for a loan of KRW 80,000,000 from the National Housing Fund, to the account of a national bank in the name of the lessor, and received KRW 80,00,000 from the bank around August 11, 2014, the Defendant deposited KRW 80,000 from the Defendant’s account in full.
Accordingly, the Defendant was given KRW 80 million by deceiving the victim in collusion with C, etc., by deceiving the victim.
