2. Determination

A. 1) The Plaintiff filed a claim for mental compensation with the Defendant on the premise that there was a fraudulent act between the Defendant and C. In this regard, the Defendant asserts that the Defendant did not commit an act to the extent of the illegal act, while closely related to C working in the same industry. 2) In light of the following facts: (a) the Defendant, even though having been aware of the aforementioned basic facts; and (b) the number and contents of text messages with the Defendant and C, which can be known through the entire purport of the arguments and the entire purport of the arguments, the Defendant shall be deemed to have knowingly committed a fraudulent act with C and maintained an inappropriate relationship; and (c) the Defendant shall be deemed to constitute a tort against the Plaintiff, who is a spouse under the law of C, and thus, the Defendant is obligated to compensate for mental damage suffered by the Plaintiff.

B. As to the amount of consolation money that the Defendant is liable to compensate, the amount of consolation money shall be determined as KRW 10,000,000, considering the health team, the period and family relationship of the Plaintiff and C, the degree and period of the Defendant’s misconduct and the period, time and lapse, and all other circumstances shown in the argument of the instant case.
