The prosecutor's appeal is dismissed.

1. The summary of the grounds for appeal (e.g., imprisonment with prison labor for six months and two years of suspended execution, probation) of the lower court is deemed to be too uneasible and unfair.

2. In light of the fact that the Defendant habitually abused her mother of this case, and that he/she was arrested as an offender and thereby repeatedly commits the same crime after he/she was released, there is a lot of risk of recidivism.

However, in full view of the reasons for sentencing and the record of the instant argument, including the fact that the victim wished to be able to simply support the Defendant from the investigative agency to the court of the trial, and the victim appears to be separated from the Defendant and his residence, the lower court appears to have been determined appropriately by fully considering all the circumstances including various sentencing grounds asserted by the prosecutor, and no special circumstance exists to the extent that the lower court’s punishment is to be changed.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the ground that it is without merit.
