The plaintiff's claim is dismissed.

Litigation costs shall be borne by the plaintiff.

1. Facts of recognition;

A. On April 19, 2018, the deceased A (hereinafter “the deceased”) subscribed to the “D” insurance to which the Defendant was the insured (hereinafter “instant insurance contract”) on April 19, 2018.

The instant insurance contract provides that the Defendant shall pay KRW 40 million insurance money if the Deceased, who is the insured, becomes final and conclusive as cancer.

The plaintiff is the only heir of the deceased with his children.

B. On October 23, 2017, the Deceased (hereinafter “instant hospital”) was performed on October 24, 2017, with hurg and knee kneoman to the E Hospital (hereinafter “instant hospital”), and was performed on October 24, 2017.

On October 24, 2017, the Deceased observed two infinites in the physical condition of the inter-face surface and two infinites generated from both sides of the livers, which were implemented before the operation, and the chronic disease and liver cancer or the livering livers accompanied by the livers were doubtful.

On October 25, 2017, the medical personnel of the instant hospital explained the result of the incubation test and the result of the blood test of the instant case to the Deceased, and explained that it would compromise with the inside and outside of the instant hospital on the same day. On the same day, the Deceased was subject to the CT test (hereinafter “CT test of this case”).

The medical team of the instant hospital diagnosed the Deceased with chronic diseases, chronopic livers, sexual livers accompanied by livers, and forest type symptoms, and around 16:49 on October 26, 2017.
