Punishment of the crime

The defendant of "2018 High 1372" is an employer who performs personal construction business using 7 full-time workers while living in the Nam-gu Incheon Metropolitan City B Apartment 802 Dong 1202 Dong-gu.

When a worker dies or retires, the employer shall pay the wages and other money or valuables within 14 days after the cause for such payment occurred.

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant did not pay the total amount of KRW 15,30,000 for workers within 14 days from the date of retirement, as shown in the attached list of crimes, as well as KRW 1,360,000 for retired D's wages, at the construction site of remuneration for the Seo-gu Incheon Metropolitan City, from November 22, 2016 to December 5, 2016, as well as KRW 1,360,00 for the total amount of wages of 13 workers, as in the attached list of crimes.

The defendant of "2018 High 1551" is an employer who performs private construction business using 7 full-time workers while living in the Nam-gu Incheon Metropolitan City B Apartment 802 Dong 1202 Dong-gu.

When a worker dies or retires, the employer shall pay the wages and other money or valuables within 14 days after the cause for such payment occurred.

Nevertheless, at the construction site of the 10th floor building in Jung-gu Incheon Metropolitan City, which the defendant contracted and constructed, the sum of the wages in arrears in the number of retired workers 14,195,000 won, as shown in the attached Table, as well as the total of the wages in arrears in the number of retired workers 14,195,00 won, and the number of the wages in arrears in the number of retired workers 2,975,000 won, including the wages in the number of retired workers 2,58,000 won, and the wages in arrears in the name of retired workers 1,10,000 won, including the wages in June 21, 2016 and the wages in the number of newly constructed construction sites constructed by the defendant under contract from June 13, 2016 to June 29, 2016, which were executed by the defendant, including the wages in arrears 2,58,000 won in the name of retired workers 2,00 won.
