The defendant's appeal is dismissed.

The summary of the grounds for appeal by the defendant is that the punishment of the court below (ten months of imprisonment) is too unreasonable.

In light of the following factors: (a) the Defendant deceivings the victim from G to purchase gold in advance under the Defendant’s prior plan; (b) obtained the victim’s trust who employed the victim for about 2 years; (c) the Defendant violated the victim’s trust; and (d) made it difficult for the victim to operate the business by acquiring the high amount of KRW 75 million and making it difficult for the victim to engage in the business because the circumstances of the victim’s management business were difficult due to the difficulties; (b) the degree of damage caused by the instant crime was serious; (c) the victim was not recovered from damage up to the trial; and (d) other various sentencing conditions indicated in the instant argument, such as the method of the instant crime, the background and background of the crime; (c) the Defendant’s age and character and conduct, etc., are considered as unreasonable, and thus, the Defendant’s argument is without merit.

Therefore, the defendant's appeal is without merit, and it is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act. It is so decided as per Disposition.
