A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. The crime committed on May 12, 2016;

A. Violation of the Road Traffic Act (CPoter measures) is a person who is engaged in driving of the Cpoter Ⅱ.

On May 12, 2016, the Defendant driven the above vehicle while under the influence of alcohol 0.149% of blood alcohol concentration on 20:43 on May 12, 2016, and led the Defendant to drive the vehicle in front of the 777 U.S. west-ro, the West Hong-gun, Hongsung-gun, bypassing it from the right side of the additional rith to the right side of the official distance.

At the time, there was a night and a place where the center line of the yellow-ray is installed, so there was a duty of care to prevent accidents in advance by safely driving a person engaged in driving service with his own car line in a clear spirit.

Nevertheless, the Defendant, under the influence of alcohol, was under the influence of alcohol and was driven by the victim D, who was driving at the right edge of the center line on the patriarchal distance from the ewing and the driver’s pande part prior to the driver’s seat of the Ewing-III truck operated by the victim D, who was driving at the right edge of the center line.

Ultimately, the Defendant did not immediately stop and take necessary measures while destroying the repair cost of KRW 2,469,00 to the victim’s vehicle due to such occupational negligence.

B. Violation of the Road Traffic Act (driving) the Defendant driven the said cargo vehicle under the influence of alcohol by 0.149% at a distance of about 6Km from the front of the Hongsung-gun, Hongsung-gun, to the place where the said accident occurred on the road.

2. On July 21, 2016, the Defendant, at around 19:15 on July 21, 2016, driven a C Poter vehicle while under the influence of alcohol with a blood alcohol content of about 0.188% without a vehicle driver’s license at the section of approximately 3.5 km from the front side of the Defendant’s house located in Hongsung-gun F to the front side of the Gansan-gun of Hongsung-gun, Hongsung-gun, Chungcheongnam-gun.
