1. The plaintiff's appeal is dismissed.

1. Determination on the cause of the claim

A. On June 24, 2016, the Plaintiff asserted that he was injured by knife with knife on the part protruding and protruding kn while normally using the electric wheelchairs produced by the Defendant (hereinafter “instant electric wheelchairs”).

(hereinafter referred to as the “instant accident.” Although the term of the electric wheelchairs of this case was six years, it was manufactured in 2014 and around two years thereafter, the manufacturing defect occurred in which parts were excavated and discharged as above, and pursuant to Article 3(1) of the Product Liability Act, the Defendant is obligated to pay 9,966,000 won (i.e., medical expenses of KRW 1,206,000, KRW 5,510,000, KRW 3,000,000, KRW 250,000 for the repair cost of the electric wheelchairs of this case).

B. A manufacturer who manufactures and sells one product is liable to manufacture and sell the product with safety and durability within the expected range in light of its technical level and economic feasibility at the time of its distribution. In the event that any defect in safety and durability occurs to consumers due to such defect, the consumer is liable to compensate for tort. Meanwhile, in the event that only the manufacturer is aware of the defect in the product manufactured in large volume due to the concentration of technology, the process of manufacturing the product is limited to the manufacturer, and it is extremely difficult for the consumer to prove scientific and technical causation between the defect in the product and the occurrence of the damage, and it is difficult for the consumer to prove scientific and technical causation between the defect in the product and the occurrence of the damage.
