Reasons
Punishment of the crime
1. The Defendant A had lent KRW 60,000,000 as business investment money to the said E during a period of one year prior to the date of internal relationship with the E, but the E had not repaid it, in collusion with the Defendant B who had been the previous year, filed a complaint against the E to receive money by rape.
Defendant
A around 03:00 on January 29, 2013, at the defendant's house located in the Nam-gu Incheon Metropolitan City F, and had sexual intercourse with E by obtaining consent from the defendant's house located in the Nam-gu Incheon Metropolitan City, and by obtaining consent from E at the same place around 03:0 on March 30, 2013.
Nevertheless, after the Defendants conspired as above, at around April 13, 2013, the Incheon Jung-gu Police Station located in the port-dong Incheon Jung-gu, Jung-gu, Incheon, submitted a complaint stating that “E has been punished for rape by assault and intimidation on two occasions.”
As a result, the Defendants filed a false complaint for the purpose of having E criminal punishment.
2. On April 2013, the Defendants filed a false complaint with the victim E, as stated in paragraph 1, and Defendant A called, “I would know to the family, if I would have to complete the payment of the money.” Defendant B called, “I would know to the family,” and called, “I would go back to the son, I would go back to the son, and I would go back to the son. I would pay back the money. I would not get you to go back to the son.” On May 2013, the Defendants called, “I would go back to the son?” and called, “I would go back to the son and go back to the son.” On June 2013, 2013, I would go back to the son who called, “I would go back to the son?” and called, “I would go back to the son?” and called, “I would go off to the son, I would go off to the son.”
As above, the Defendants jointly attacked the victims and carried frightened therefrom to the Nam-gu Incheon Metropolitan City G around June 14, 2013.
