나. 피고인은 2019. 3. 초순경 주말인 어느 날 오후에 피해자에게 ‘바람을 쐬러 가자’고 하여 위 승용차에 피해자를 태우고 안동시 H 모텔에 운전하고 가서 위 모텔 I호에 투숙한 후 침대에 누워있는 피해자의 옷을 벗기고 피해자의 음부에 성기를 삽입하여 간음하였다.

다. 피고인은 2019. 3. 13. 11:00경 피해자에게 ‘바람을 쐬러 가자’고 하여 위 승용차에 피해자를 태우고 안동시 J에 있는 ‘K 모텔’에 운전하고 가서 위 모텔 L호에 투숙한 후 피해자에게 옷을 벗으라고 하여 옷을 벗기고 피해자의 음부에 성기를 삽입하여 간음하였다. 라.
