Defendant shall be punished by a fine of five million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

1. On November 30, 2017, the Defendant violated the Act on Probation and the Attachment, etc. of Electronic Devices against specific criminal offenders is a person subject to attachment of electronic device and a person subject to probation from October 7, 2018 to October 6, 2021 upon receipt of a decision issued by the Ulsan District Court to order the attachment of an electronic tracking device for three years.

A person with an electronic tracking device installed shall observe matters to be observed, such as “to throw away bad habits leading to a crime, to teach or interfere with persons who are likely to commit a crime,” “to comply with the direction and supervision of a probation officer, and to answer if visiting him/her,” etc. If he/she violates such rules without justifiable grounds, he/she may be urged by the head of the probation office to perform the matters to be observed and be subject to disadvantageous disposition, such as the execution of punishment, etc., and shall not violate the above matters to be observed again after receiving the warning.

Around 23:50 on October 12, 2018, the Defendant, while drinking alcohol in the Ulsan Jung-gu R market, was under the influence of the probation officer S, refused to comply with the probation officer’s instructions by drinking while under the influence of alcohol. On October 23:13, 2018, the Defendant continued to comply with the probation officer’s instructions by failing to comply with the probation officer’s instructions. On October 21, 2018, the Defendant was under the influence of alcohol on the front of the F in Ulsan-gu, Ulsan-gu, U.S., where he was under the influence of alcohol. On October 21, 2018, the Defendant breached the duty to comply with the direction of the probation officer, as well as on October 21, 2018.
