A, 피고인 B은 평소 불특정다수의 일반인들에게 ‘모르는 사람한테 티팬티 보여주기’, ‘모르는 사람 앞에서 야하게 말하기’, ‘혓바닥 붙이고 떼어달라고 말하기’ 등 속칭 ‘몰래카메라 영상’을 촬영하여 이를 업로드한 다음 위 채널을 구독하는 시청자들에게 방영하고 같은 방법으로 채널 구독자를 모집하여 결국 시청자 수에 따라 광고수익을 얻는 방법으로 위 채널을 운영하여 오던 중, 2020. 1.경 ‘신종 코로나 바이러스(이하 ’코로나19 바이러스‘라고 함)’ 관련 감염병이 전세계적으로 확산되고 국내에서도 확진자가 발생하여 병원, 어린이집 등이 폐쇄되는 등 감염병의 전파 및 확산에 대하여 전국민의 관심이 집중되자 위와 같은 상황을 이용하여 ‘몰래카메라’ 영상을 촬영한 다음 이를 위 채널에 업로드하여 시청자를 모집하고 광고수익 등을 얻기로 마음먹고 피고인 A, B 및 단기 아르바이트로 고용한 위 피고인 C, D을 각각 방역 관계자 또는 감염자로 분장하게 한 다음 불특정다수의 철도 고객들이 이용하는 I에서 마치 실제 감염자가 도주를 하고 방역 관계자가 이를 추격하는 듯한 연기를 하고 그 영상을 촬영하기로 공모하였다.
