1. Defendant A, B, C, D, E, F, G, H, I, J, K, L, M, N,O, P, Q, R, and T Co., Ltd. shall be jointly and severally against the Plaintiff (Counterclaim Defendant).

A principal lawsuit and a counterclaim shall be deemed simultaneously.

1. The facts of recognition are as follows: (a) the other Defendants except the Defendant (Counterclaim Plaintiff) U and V and 33 members of W and X (hereinafter “the first members”) form a “Z Association” (hereinafter “Z Association”) around September 2007 in order to construct a household complex by constructing a new building on the land of Pyeongtaek-si, Y and 11 lots (hereinafter “instant project site”) as a household retailer; (b) appoint Defendant J as its representative and delegate the power to purchase the instant project site and select the contractor and conclude the contract.

After that, W transferred to Defendant U, and X transferred each co-ownership share on the instant project site to Defendant V.

On March 17, 2009, the Plaintiff entered into a contract with Defendant J, on behalf of the first members of the instant organization, setting the construction cost for the AA household complex located in the instant project site from the first members as KRW 6.93 billion (including value added tax).

On December 8, 2009, the Plaintiff prepared a written final contract with Defendant J on December 8, 2009, setting the construction period of KRW 8 billion (including KRW 660 million for the first additional construction cost of KRW 660 million for the second additional construction cost of KRW 340 million for the third additional construction cost of KRW 377 million for the third additional construction cost of KRW 340 million for the second construction cost of KRW 660 million), including the first,2, and the third additional construction cost for the said AA household complex from 2009 to 2010.

(2) On September 3, 2010, the Plaintiff entered into an additional construction contract with Defendant J on September 1, 2010 to September 30, 2010 to set the construction period for household complex road works and miscellaneous works as KRW 275 million, respectively.

The Plaintiff completed the instant construction and obtained approval for the use of the instant building on January 24, 201, and the instant construction.
