Punishment of the crime

On August 6, 2008, the Defendant was sentenced to a fine of one million won for a violation of the Road Traffic Act by the Jeju District Court.

Criminal facts

1. The Defendant is a person who is engaged in driving Class B cargo vehicles in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes;

On July 19, 2020, the Defendant driven the above cargo while under the influence of 0.181% of blood alcohol level on July 20, 2020, and proceeded ahead of the 1st parallel road at Taepo-ro 71-43, Taepo-si, Seopo-si, 143, Seopo-si, Seopo-si.

At the time, the surrounding areas were kept at night, and there was a place where traffic was controlled by signal, etc., so in such a case, there was a duty of care to reduce speed as a person engaged in driving a motor vehicle, to see the front door, to accurately manipulate the steering and operation of the steering system, to prevent accidents in advance.

Nevertheless, the Defendant, while under the influence of alcohol, was negligent in failing to discover the victim C(the age of 26)'s (the age of 26) driving who was in the atmosphere of the signal at the front, and was behind the victim C's vehicle due to the Defendant's fault.

In the end, the Defendant, while driving a freight vehicle under the influence of alcohol which is difficult to drive normally, suffered injury to the injured party C, such as cryposis and tension, and injury to the injured party E (V, 24 years old) who was on a passenger car of the injured party C, for about two weeks of treatment.

2. The Defendant violated the Road Traffic Act (driving) by driving the freight vehicles described in paragraph (1) on two occasions, while under the influence of alcohol at about 4 km from the G convenience store in order to the place of the accident described in paragraph (1) at the time of Seopopoposi, G convenience store located in the F, and thereby driving the freight vehicles described in paragraph (1) at a level of about 0.181%.
