A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On March 2013, the Defendant: (a) requested the Victim Savings Bank Co., Ltd. (hereinafter “victim Bank”) to grant a loan under the name of mechanical purchase fund; and (b) attempted to submit false data to the person who was requested to submit data verifying the deposit of the remainder of the money except the amount of loan application from C and D to receive the loan.

Around March 2013, the Defendant filed an application for a loan of KRW 200 million at the head office of the victim bank located in 108, as the machinery purchase fund, with the intent to verify that the Defendant provided food and resource-generating equipment machinery supplied by Boenna Co., Ltd. (hereinafter “ Boenna”) as security, and paid the price of the machinery provided as security,” the Defendant submitted a statement to C of the victim bank “the payment of KRW 800 million for Boenna,” which read “the payment of the price of the machinery provided as security.”

In fact, the Defendant paid approximately KRW 400,000,000,000,000 for machinery type 1 billion for Bosten, and the Defendant did not have paid KRW 800,000 for Bosten. The deposit slip submitted by the Defendant was a false deposit slip prepared without actual deposit. Therefore, the ownership of the machinery type offered by the Defendant as security was reserved in Bosten.

On April 19, 2013, the Defendant received 199,85,000 won, under the name of the loan, from the victim, after making a false statement to the victim, from the victim.

Accordingly, the defendant was given property by deceiving the victim.
