A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On October 7, 2011, the Defendant was sentenced to six months of imprisonment for a crime of fraud in the Goyang Branch of the District Court, and completed the execution of the said sentence in the medical prison on or before March 30, 2012.

1. On October 14, 2012, around 16:20 on October 14, 2012, the Defendant ordered two persons, two (2) disease, two (2) disease, and one (1) disease of drinking water to the victim, as if he would pay the food value, at the E-cafeteria operated by the victim D in Dongducheon-si, Dongbcheon-si.

2. On November 3, 2012, around 01:45, around November 3, 2012, the Defendant ordered two persons, two (2), and two (2) bottles to the victim, as if he would pay the food value at the H restaurant operated by the Victim G in Dongducheon-si. F.

However, even if the defendant was provided with food from the victim, he did not have the intention or ability to pay the food value.

The Defendant was provided with food equivalent to KRW 30,000, in total, from the victim’s seat.

Accordingly, the defendant was given property by deceiving the victim.

3. On November 4, 2012, around 18:30 on November 4, 2012, the Defendant ordered the Defendant to pay the Defendant food value at K, operated by the Victim J in Dongducheon-si, Dongducheon-si, as if he would pay the Defendant the food value.

However, even if the defendant was provided with food from the victim, he did not have the intention or ability to pay the food value.

The Defendant was provided with food equivalent to KRW 39,000, in total, from the victim’s seat.

Accordingly, the defendant was given property by deceiving the victim.

4. On November 6, 2012, the fraud Defendant is N. 21:45 on November 6, 2012, operated by the victim M in Dongducheon-si L.
