A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

On June 2019, the Defendant received a proposal that “10% of the amount to be delivered will be paid as allowances” from a person who was aware of his/her knowledge through the job offering comments posted on the “D” website, which is a job offering and seeking site.

Accordingly, by misrepresenting the public prosecutor to the effect that "the person whose personal information has been leaked, transfers money to the bank account in his/her name, and deliver the physical card connected to the account to the execution officer dispatched by the Seoul Central District Inspection Team in an envelope", and the defendant was willing to collect the physical card from the victims in order to commit the telephone financial fraud crime (the "scaming"), by withdrawing the cash after receiving the physical card from the victims.

On June 19, 2019, at around 10:00, the name-free person called the victim E at a non-place, and misrepresented the victim E to the Seoul Central District Public Prosecutor's Office's Financial Fraud crime. In order for the party to verify whether the personal information was leaked, he/she transferred the money in the subscription passbook to the bank account in the name of the party, and transferred the money in the name of the party to the account, and transferred the physical card connected to the account in the envelope to the execution officer dispatched by the Seoul Central Public Prosecutor's Investigation Team in the envelope."

In the above false statement, the name-freeist transferred the money to the victim, and had the victim take the physical card connected to the H bank account (I) in the name of the victim, and had him/her hold the physical card as a place (the place of receiving money) directed by the victim in an envelope.

On June 19, 2019, at around 14:00 on June 19, 2019, the Defendant moved to the front of the exit No. 77 World Cup, Seoul Mapo-gu, Seoul, to the front of the exit, and runs as if the Seoul Central District Prosecutor’s Investigation Team was dispatched, and the Defendant was above the victim.
