1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

The defendant is a corporation that is engaged in the repair, reinforcement, unclaimed classes, etc. of facilities.

The Plaintiff was a person holding 5,555 shares out of 50,50 shares issued on the Defendant’s list of shareholders (as of December 31, 2015), and was appointed as the Defendant’s representative director on February 25, 2009, and was reappointed on March 26, 201, and registered as the representative director on March 31, 201, and retired from office on March 31, 2017.

The Plaintiff’s husband D owned 19,190 shares of the Defendant (based on December 31, 2015) and registered as an in-house director, and retired from office on March 31, 2017.

The Defendant’s remaining shares hold 15,250 shares of E, and 4,575 shares of E’s children G (as of December 31, 2015). E owned 5,930 shares, and transferred all shares to H on September 23, 2015.

(H) The Defendant’s shareholder registry is not a change of shareholder in the Plaintiff’s shareholder registry). After the process of the application for provisional disposition against the Plaintiff and D, H applied for provisional disposition seeking suspension of the performance of duties and appointment of an acting representative against the Plaintiff ( Daejeon District Court Decision 2015Kahap50315), and February 19, 2016, upon acceptance of the above application, the Plaintiff and D’s provisional disposition suspending the performance of duties and appointment of an acting representative, the Plaintiff and D’s first decision was rendered.

The Plaintiff’s acting attorney I resigned on April 6, 2016, and on April 21, 2016, the attorney J was replaced by the acting attorney by the court’s decision, and on June 8, 2016, H was replaced by the Plaintiff’s acting representative.

On January 11, 2017, the Plaintiff and D filed an application for provisional disposition with the Daejeon District Court 2016Kahap50331 regarding the above decision ( Daejeon District Court 2015Kahap50315). The said court accepted the above objection and revoked the decision of provisional disposition suspending the performance of duties and the decision of replacing each acting director, and dismissed the application for provisional disposition by H.

On January 20, 2017, H made a decision to revoke the above provisional disposition, on January 20, 2017.
