1. Defendant C’s KRW 48,00,000 and the Plaintiff’s annual rate of KRW 5% from July 1, 2007 to April 21, 2017.
Reasons
1. Basic facts
A. Defendant B is a licensed real estate agent of F Licensed Real Estate Agent in Seocho-gu, Busan Metropolitan City, and Defendant C is an employee of the above F Licensed Real Estate Agent, and Defendant D is an employee of the said F Licensed Real Estate Agent, and Defendant D is an employee of the H real estate located in Ilyang-gu, Busan Metropolitan City.
B. On October 26, 2006, I entered into a sales contract for the right to sell lots of KRW 252,250,000 (i.e., KRW 94,250,000 for an intermediate payment of KRW 128,000 for an intermediate payment of KRW 128,000,000,000, which was paid by J at the time of the remainder of the sale price, on the part of the 102 building and the sale price of KRW 1102,00,000, which was already paid by the JJ (hereinafter “instant sale right”). The special terms and conditions on the sales contract for the said right to sell lots of KRW 122,000 for a buyer at the time of the remainder of the sale price stipulated as “the condition that the buyer shall prepare at the time of the remainder of the sale price at KRW 22,00,000.”
C. On November 10, 2006, the Plaintiff offered a proposal for the purchase of the instant parcelling-out right from Defendant C, and entered into a sales contract with Defendant D’s agent to purchase the instant parcelling-out right at KRW 282,250,000 (i.e., purchase price of KRW 94,250,000 for intermediate payment of KRW 94,250,000 for intermediate payment of KRW 128,000,00 for KRW 60,00 for intermediate payment of KRW 94,250,00 for the sale price paid by the J). The Plaintiff participated in the sales contract with Defendant D’s agent under the said sales contract, stating that “The said sales contract shall be amended to KRW 22,00,000 for the remainder payment of KRW 60,00 for the said intermediate payment.”
From November 10, 2006 to December 4, 2006, the Plaintiff paid to Defendant B, etc. KRW 154,250,000, excluding an intermediate payment loan of KRW 128,000,00 in accordance with the sale and purchase agreement as above.
E. After that, on December 4, 2006 between the Plaintiff and J, the sales amount of KRW 22,00,000,000, which was already paid by J as to the right to sell the instant case, is added to the sales amount of KRW 244,250,00.
