가. 원고는 2006. 10. 27. 토목건축공사업(등록번호 10-0390호) 등록을 마친 법인이다.

나. 피고는 건설업 등록사항 신고서 자본금 관련 심사결과 원고의 실질 자본금이 2015년 결산일 기준으로 건설업 등록기준 중 토목건축공사업을 영위하는 법인의 자본금 요건(12억 원 이상)에 미달한다는 이유로, 2016. 12. 28. 원고에 대하여 건설산업기본법 제83조 제3호, 제10조, 같은 법 시행령 제13조 제1항, 제80조 제1항에 따라 영업정지 5개월의 처분(영업정지 기간: 2017. 1. 6. ~ 2017. 6. 5., 이하 ‘이 사건 처분’이라 한다)을 하였다.

C. On March 3, 2017, the Plaintiff filed an administrative appeal seeking revocation of the instant disposition with the Central Administrative Appeals Commission, but the Central Administrative Appeals Commission rendered a ruling dismissing the Plaintiff’s claim on May 15, 2018.

3. Whether the instant disposition is lawful

A. The Plaintiff’s assertion 1) The Defendant did not explain the cause of the disposition or legal basis to the Plaintiff in the hearing procedure, but did not formally proceed with the hearing procedure, and caused the Plaintiff to lose the opportunity to vindicate and submit favorable materials. The instant disposition is procedural defect in violation of Article 31(1) of the Administrative Procedures Act. 2) The Plaintiff’s 259,873,468 won subtracting the pledged amount out of the ordinary deposit 1,149,535,900 won on the statement of financial position in 2015 should be incorporated into the real asset. Considering this, the Plaintiff’s total capital in 2015 shall be approximately KRW 1,380,000,000 for the registration standard of construction business under the relevant Act and subordinate statutes, and thus, the Plaintiff’s capital fell short of the Plaintiff’s standards for the registration of construction business by misunderstanding the fact.
