1. The Defendant shall pay to the Plaintiff KRW 7,044,019 as well as 20% per annum from January 28, 2015 to the day of full payment.
Reasons
1. On September 1, 2014, the Plaintiff: (a) transferred the sum of KRW 25,000,000 to the Defendant’s New Bank C account; and (b) the balance of the said account is KRW 7,044,019.
The plaintiff seeks return of unjust enrichment.
(1) Article 208(3)3 of the Civil Procedure Act provides that “The right to claim restitution of unjust enrichment is a claim with no fixed deadline, and thus, the person obliged to return the claim becomes liable for delay from the time of receipt of the request for performance.”
