1. The Defendant-Counterclaim Plaintiff (Counterclaim Defendant) amounting to KRW 34,325,545 and its amount from February 27, 2019 to October 17, 2019.

A principal lawsuit and a counterclaim shall be deemed simultaneously.

1. Basic facts

A. From five to six years before the Plaintiff was hospitalized in the Defendant Hospital and the first surgery 1) The Plaintiff was hospitalized in the Defendant Hospital on July 12, 2016, for the following reasons: (a) the Plaintiff was hospitalized in the hospital at the meeting of the Council, which caused a simple pain on the right shoulder; and (b) on May 12, 2016, the Plaintiff was diagnosed as “the part to the right shoulder to the right shoulder.” (c) after being hospitalized in the hospital, the Plaintiff was hospitalized in the E hospital on two to three occasions on the right shoulder, and was hospitalized in the hospital on two occasions on the right shoulder, and the pain continued; and (d) the Plaintiff was hospitalized in the Defendant Hospital on July 12, 2016.

3) 2016. 7. 12. 진료 당시 원고는 우측 견관절의 능동적 전방거상 각도가 50도로 매우 낮았고, 거상시 통증이 심하였으며, 수동적 전방거상은 135도로 경직이 동반되어 있는 상태였고, 또한 E병원에서 시행한 우측 견관절 MRI 검사와 피고 병원에서 시행한 우측 견관절의 초음파 검사 결과 ‘우측 회전근개 부분파열과 우측 상완이두근 장건의 부분파열 및 탈구’ 소견이 관찰되었다. 한편 입원 당시 시행한 원고의 혈액검사 결과 염증 등에 증가 소견을 보이는 백혈구, CRP(C-반응성단백질, 단위: mg /㎗, 참고치 0.5~1.0), ESR(적혈구침강속도, 단위: mm /hr, 참고치 0~20) 등 전신 염증반응에 대한 수치는 정상 범주였다. 4) 피고는 다음날인 2016. 7. 13. 08:00경 원고에 대하여 관절경적 회전근개 변연절제술(A/S RC debridement), 관절경적 이두박건절단술(A/S biceps tenotomy),...
