1. 특수공무집행방해 피고인은 2018. 5. 10. 19:08경 E에 있는 D시청 현관 앞에서, ‘사기꾼 시장!! D 통째로 다 말아먹고 끝낼거냐, 시장한테 원한있는 사람들은 다 모여서 사기치고 도망가는 시장 월급 다시 받아냅시다, 나는 오늘부터 여기서 단식 투쟁하다가 죽는다. 어느 놈이던 태클 거는 놈은 칼부림난다.’라는 문구의 현수막이 걸린 F 화물차량을 주차한 후 1인 시위를 하고 있던 중 D시청 소속 청원경찰인 피해자 G이 피고인에게 청사 관리 규정상 청사 밖에서 시위를 하라며 제지하자, 이에 화가 난 피고인이 “1인 시위는 시청 안에서 해도 된다, 경찰청에 다 물어봤다.”라고 거절하였음에도, 피해자가 재차 청사 밖으로 나가 줄 것을 요청하였다는 이유로 피고인의 화물차량에 보관중인 낫(칼날 20cm, 손잡이 20cm)을 손에 들고 피해자를 향해 “건들면 죽이고, 나 죽는다.”며 피고인의 머리 위로 낫을 치켜세우는 등 피해자 G의 신체에 어떠한 위해를 가할 듯한 태도를 보여 피해자를 협박을 하였다.
