A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 2015. 7. 29. 09:25경 삼척시 삼척로 3138에 있는 동막사거리 노상에서 B 제네시스 승용차를 운전하면서 휴대전화를 사용하여, 이를 목격한 삼척경찰서 C파출소 소속 경사 D으로부터 도로교통법위반 사실로 단속되면서 운전면허증 제시를 요구받자, 이에 거부하며 “뭐하는 거야, 차를 왜 막아 씨발”, “도로에서 차를 막고 뭐하는 거야”, “씨발 놈들아”, “장난 치냐 이 새끼들아”라고 욕설을 하고, 위 경찰관을 뿌리치고 차량에 탑승하여 약 30cm를 전진하던 중 같은 파출소 소속인 피해자 경사 E(39세)이 이를 제지하자 차에서 내리며 “야 이새끼들아 내가 뭘 위반한 게 있냐고”, “야 이 새끼들아”, “씨발놈아 당신이 뭔데 차를 막아, 장난치냐 새끼야”라고 계속 욕설을 하면서 양팔로 피해자의 가슴을 강하게 2회 밀치고, 오른 주먹으로 목 부분을 1회 쳐 피해자에게 약 2주간의 치료가 필요한 기타 목 부분의 표재성 손상, 타박상의 상해를 가하였다.

Accordingly, the defendant interfered with legitimate performance of traffic control duties in the above slope E, and at the same time injured the victim E.
