Reasons
Punishment of the crime
Defendant
A was selected by going out from the second election of the president of the National Association on March 13, 2019, and Defendant B is a member of the said association.
1. Defendant A
(a) No one shall provide, manifest an intention to provide, or promise to provide, money, goods, entertainment, or other property benefits to an elector for an election campaign in violation of the Act on Entrusted Elections by Public Organizations, Etc.;
Nevertheless, around January 6, 2019, the Defendant issued 300,000 won in total to the members E, 4.6 million won in total, and 2 million won in total, from that time to March 2, 2019, as shown in the list of crimes in attached Form B, from that time, to March 2, 2019, upon requesting the members B to engage in one’s election campaign.
Accordingly, the defendant provided a total of 6.6 million won to the elector for his election campaign.
(b) No election campaign shall be carried out unless the election campaign period is in violation of the Act on Elections by Public Organizations, etc. (violation of Restriction on Election Campaign).
Nevertheless, on February 21, 2019, the Defendant sent electronic registration mail to the above C members 1,153 for the purpose of one’s own election campaign at a post office located in the south-gu at an port on February 21, 2019, which is not an election campaign period.
Accordingly, the defendant carried out an election campaign even though it is not an election campaign period.
2. No person shall be provided with, or consent to an expression of intent to provide, money, goods, entertainment, or any other property benefits provided to an elector for the election campaign against Defendant B;
Nevertheless, the Defendant received 300,000 won in cash from a candidate A who was requested by the president of the CF to engage in an election campaign around January 6, 2019, from that time until March 2, 2019.
