1. The plaintiff's claim is dismissed.

1. Basic facts

A. On November 25, 199, the Plaintiff acquired 36,694 square meters of land D (hereinafter “instant land before the instant partition”) in Ulsan-gun, Ulsan-gun (hereinafter “Cri”) which was owned by B on November 25, 199 by public sale, and completed the registration of ownership transfer on the said land on December 7, 199.

B. On January 3, 200, in the instant land before the instant partition, ① the E forest land was divided into 77 square meters on January 3, 200, and the registration of ownership transfer was completed on the said land as a result of the consultation on March 14, 2000 in the Ulsan-gu Seoul Special Metropolitan City, Ulsan-do. ② the said land was divided into F forest land 4,542 square meters on March 18, 200, and the registration of ownership transfer was completed on the said land as a result of the consultation on the land for the same day in the front of the Ulsan Metropolitan City Urban Corporation. ③ The registration of ownership transfer was completed on the said land divided into G forest 27,308 square meters on January 21, 209 and registered on April 9, 2009 on the said land as a result of the consultation on the land for public use on the same day, each of the said land was divided into the forest and forest 214 square meters on April 1, 2015.

As a result, only 3,374 square meters of the land before the division of this case remain.

On November 29, 1982, the land of this case was designated as the "K upper stream river" as the Jannam-do Public Notice on November 29, 1982, and is also designated as the river area under the River Act until now.

As of September 20, 2018, the instant land is entirely incorporated into the K river area, and the part among which part is 600 square meters of water flow and 2,774 square meters of water flow on both sides is a sand and gravel land.
