Reasons
Punishment of the crime
The defendant is the E representative in Yangsan-si D.
1. On July 25, 2012, the Defendant reported the confirmation of value-added tax for the first time in 2012 to the Busan Geum-dong, Geum-gu, Busan, the Busan, on a commercial basis, around July 25, 2012, the Defendant submitted a false list of total tax invoices equivalent to KRW 6,397,422,515, as shown in the annexed crime list 1, as if E were to have supplied scrap metal, although the Defendant did not supply goods to the above seller.
2. The Defendant filed a return on the confirmation of value-added tax for profit at the time, place, 2012 at the time, and place specified in paragraph (1), and the Defendant filed a false list of total tax invoices equivalent to KRW 883,007,050 of the value of supply as stated in the attached crime list 2, even though the Defendant did not purchase goods from six purchasers, such as F, even though he did not purchase the goods.
3. On January 25, 2013, the Defendant filed a false report on the determination of value-added tax for the following reasons: (a) around January 25, 2013; and (b) around two years 2012, the Defendant reported on the determination of value-added tax; and (c) despite the fact that the above E supplied goods to nine selling places, such as G, etc., the Defendant submitted a false entry of the total value of the supply price of KRW 3,086,916,990, as indicated in the attached list 3, as if E
4. The Defendant reported the establishment of value-added tax at the time, place, 2012 at the time, and place specified in paragraph (3). In fact, the Defendant submitted a false entry of the total value of tax invoice equivalent to KRW 136,907,700, as indicated in the attached list 4, as if E were supplied with scrap iron, etc., even though there was no fact that E was supplied with goods from two purchasing places, such as H, etc.
