A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On February 8, 2017, the Defendant was sentenced to a suspended sentence of two years for a violation of the Road Traffic Act (unlicensed Driving) at the Busan District Court on February 8, 2017, and the same year.

5. 11. The judgment became final and conclusive.

The Defendant, around October 2015, at “C” located in Busan, Shodong-gu, Busan around 1643, and at “C”, there is a business with the victim D having cashed and sold high water on the water and again selling them on other high water.

In this case, one of the investments made a false statement that “The principal and 10% of the profits will be returned immediately.”

However, even if the defendant received money from the injured party, the defendant thought that he would use the money for the construction cost of a new factory in the Haak-gun, Haak-gun, and he did not have an intention or ability to sell it to the injured party.

On October 23, 2015, the Defendant: (a) by deceiving the victim; and (b) received cash KRW 20 million from the victim of the damage, under the pretext of an investment in the F Office, from the victim of the damage under the jurisdiction of the Busan Seo-gu, Busan.

Around September 23, 2016, the Defendant issued an order for alcohol and alcohol equivalent to KRW 790,000,000 at the market price under the “I Sing shop” operated by the victim H on the fifth floor of Kimhae-si G and the victim H on the fifth floor.

However, the defendant did not have the intention or ability to pay the price even if he was provided with alcoholic beverage and alcohol from the injured party at the time.

The Defendant, as such, by deceiving the victim, was provided with alcohol and alcohol equivalent to 7.90,00 won at the market price on the same day from the victim, and was provided with alcohol and alcohol equivalent to 600,000 won at the market price on October 16, 2016, as well as alcohol and alcohol equivalent to 10,090,000 won at the market price on October 24, 2016.
