Punishment of the crime

On July 12, 2012, Defendant A was sentenced to the imprisonment of eight months for fraud in the Daejeon District Court's Incheon District Court's Branch on February 15, 2013, and the judgment became final and conclusive on February 15, 2013.

B On August 19, 2010, the Seoul Central District Court was sentenced to six months of imprisonment for fraud and two years of suspended execution, and the above judgment was finalized on November 27, 2010, and on July 12, 2012, the Daejeon District Court was sentenced to one year of imprisonment for fraud and became final and conclusive on February 2, 2013.

Criminal facts

1. Defendant A around April 10, 2012, at the third floor coffee shop in Seocho-gu Seoul Metropolitan Government, Defendant A stated that “B, from the head of the branch office of a former national bank, LB loaned the company’s PF funds to the customer at present, and deposited the bank with some shares of the company’s PF funds at present, and even after retirement, Defendant A got the current head of a bank, executive officers, and PF loans.” Defendant A stated that “The PF loans will be changed because the business feasibility of an officetel construction project currently being promoted is good.”

However, the defendant was not from the head of the branch office of the National Bank, and even if he received money from the victim, he did not have the intent and ability to obtain the PF loans.

The Defendant, by deceiving the victim as such, received 2.5 million won from the victim to the new bank account of the Defendant under the name of proxy business under the name of the victim.

A.
