1. The plaintiff
A. Defendant A indicated in the separate sheet No. 1, 2, 3, 4, 5, among the buildings on the first floor of real estate listed in the separate sheet No. 1, 2, 3, 4, 5.
Reasons
1. Basic facts
A. On December 18, 2013, the Plaintiff: (a) leased to Defendant A a lease deposit amounting to KRW 15,483,00,00, monthly rent of KRW 1,905,40; (b) the fifth day of the following month from January 1, 2014 from January 1, 2014 to December 31, 2014, the lease period of KRW 26.87,00 square meters (hereinafter “instant store”).
Article 23 of the above lease contract provides that "a lessee and a lessee shall extend the lease contract for one year under the same conditions as this contract if either of the parties has not expressed a separate intention in writing at least one month before the expiration of the term of validity of the lease contract: Provided, That the matters provided for in Articles 4 (Rental Deposit), 5 (Monthly Rent, Date of Payment), and 9 (Management Fee, Facility Fee, etc.) shall be determined separately by consultation, and Article 25 is confirmed to be "the term of this contract terminated at the expiration of the term of validity of the lease, etc."
B. Before the expiration of the above lease term, the Plaintiff sent to Defendant A a written notice to restore the store to its original state and deliver the store by the expiration date of the lease term, which is not extended, to Defendant A, and the Plaintiff sent by content-certified mail on October 28, 2014 and November 18, 2014.
Defendant A did not comply with the Plaintiff’s request for delivery even after receiving each content-certified mail as above, and even after the expiration of December 31, 2015, Defendant A continued to possess and operate the instant store together with Defendant B.
On January 15, 2015, the Plaintiff sent to Defendant A a written notice to immediately deliver the instant store, as the term of lease expires once again by content-certified mail.
C. Meanwhile, on the other hand, the pre-printed lease term under Article 2 (2) [the term of lease from January 1, 201 to December 31, 2014 (hereinafter “instant lease contract”) which Defendant A keeps].
