The summary of the facts charged of this case [the background of the crime] The defendant is the actual representative of "G", which is the company managing the Gu F site and its ground buildings located in Bupyeong-gu, Incheon, and the above real estate was sold from H and I on Nov. 26, 2003 to J and K Co., Ltd. (hereinafter "K"), and the ownership transfer registration lawsuit is finalized by the Supreme Court Decision 2009Da42130 Decided the end of the litigation for the claim for ownership transfer registration. The defendant entered into a contract for the management of the above real estate with H and I, and managed the above real estate on May 10, 2010. However, the lease contract was terminated on the ground that the rent was unpaid on September 24, 2012.

Accordingly, the Defendant alleged that H and I received the ownership of the facilities, such as the heading and list attached to the factory building attached to the above real estate, from H and I, and attempted to remove and steal them.

[Criminal facts]

1. A larceny: (a) on December 19, 2012, the Defendant: (b) removed 1, 13-dong, Co., Ltd., Ltd. (No. 19) from the 27-dong factories in Bupyeong-gu, Incheon, Seo-gu; (c) on the 13-dong (No. 19-dong, Co., Ltd.); (d) on January 4, 2013, the Defendant loaded part of the scrap metal into NF and stolen it; and (d) on the 13-2 Dong-ro (No. 56-dong, Equipment List) from the 13-dong around January 19, 2013 to the 25-dong of the same month; and (d) on the 13-dong, 13-dong, 13-dong, and 13-dong (No. 36-dong, Equipment List) from the 13-dong to the 25-dong from the 2013th of the same month.
