1. Basic facts

가. 임대차계약의 체결 원고(선정당사자, 이하 ‘원고’라 한다) 및 선정자 C(이하 원고와 선정자를 통틀어 ‘원고 등’이라 한다)은 별지 목록 기재 건물에 대하여 각 1/2 지분씩 소유하고 있고, 원고 등은 2013. 5. 15. 피고에게 별지 목록 기재 건물 중 별지 도면 표시 ㉣, ㉤, ㉥, ㉨, ㉩, ㉣의 각 점을 차례로 연결한 선내 (나) 부분 34.11㎡(이하 ‘이 사건 임대부분’이라 한다)을 임대차보증금 5,000,000원, 차임 월 500,000원(부가가치세 별도), 임대차기간 2013. 5. 24.부터 2014. 5. 24.로 정하여 임대하기로 하는 임대차계약(이하 ‘이 사건 임대차계약’이라 한다)을 체결하였다.

B. According to the facts of the judgment on the cause of the claim, the instant lease agreement was terminated on or around May 15, 2014 by the notice of termination of the lease agreement of this case on the ground of the Defendant’s delay. Thus, the Defendant is obligated to pay the Plaintiff, etc. unjust enrichment equivalent to the rent calculated on the basis of the rate of KRW 50,000 per month from July 24, 2014 to the time of delivery of the leased portion (=50,000 value-added tax of KRW 50,000 per month) as sought by the Plaintiff, etc., as the date of termination of the instant lease agreement.

3. As such, the claim of this case by the plaintiff et al. is justified.
